Today, important updates have been announced by Marc Miller, bringing significant changes to the study permit cap, work permit eligibility, and spousal open work permit criteria. These changes will impact international students and their spouses, as well as foreign workers, making it essential to stay informed about the new regulations. .

1. Work Hour Limit for Students

Full-time students can now work up to 24 hours per week.

2. International Student Cap & Changes in Study Permit Requirements

The international student cap will remain in place. For 2025, a 10% reduction has been announced, lowering the intake cap from 485,000 to 437,000. This cap will stay at 437,000 for 2026.

Starting in 2025, master’s and doctoral students will need to submit a provincial or territorial attestation letter to qualify for a study permit. Approximately 12% of the intake spaces will be reserved for these students, acknowledging their positive impact on the Canadian labor market.

Additionally, the proposed reduction of temporary residents from 6.5% to 5% of Canada’s total population will be reflected in the 2025–2027 Immigration Levels Plan, scheduled for release by November 1, 2024.

3. Changes in Post-Graduate Work Permit Eligibility

Graduates from public college programs will continue to be eligible for a Post-Graduation Work Permit (PGWP) of up to three years if their field of study is related to occupations in long-term shortage.

Starting November 1, 2024, all PGWP applicants will also need to meet new language proficiency requirements: a Canadian Language Benchmark (CLB) level 7 for university graduates and CLB 5 for college graduates. This change aims to improve their ability to transition to permanent residence and adapt to evolving economic conditions.

4. Changes for Spousal Open Work Permit

For Students: Later this year, work permit eligibility will be limited to the spouses of master’s degree students whose programs are at least 16 months in duration.

For Work Permit Holders: Limiting work permit eligibility later this year to spouses of foreign workers in management or professional occupations or in sectors (like constructions, healthcare) with labour shortages—under Canada’s work permit programs (TFWP and IMP).

Currently,

  • All Post-Graduation Work Permit (PGWP) holders are currently eligible for a spousal open work permit.

  • Students: Starting April 30, 2024, your spouse or common-law partner may also be eligible for an open work permit if you hold a valid study permit and are:

    • Studying in a master’s or doctoral degree program

    • Participating in an eligible pilot program, or

    • studying in selected professional degree programs at a university:
